These Terms of Use ("Terms") govern your use of the Wayve mobile application (iOS and Android), the website at wayvesim.com, and all related services (collectively, the "Service") provided by HopSync Technologies LLC ("Wayve," "we," "us," or "our").
By downloading the app, accessing the website, or purchasing an eSIM plan, you agree to these Terms. If you do not agree, do not use the Service.
1. Service Description
Wayve provides prepaid eSIM data plans for international travel across 200+ destinations. Our eSIMs are data-only — they do not include voice calls or SMS. Plans are delivered digitally via email and can be installed by scanning a QR code.
The Service is available through our mobile applications (iOS App Store and Google Play Store) and our website at wayvesim.com.
2. Eligibility
- You must be at least 13 years old to use the Service
- You must have an eSIM-compatible device — it is your responsibility to verify compatibility before purchase
- You must provide accurate information when creating an account or making a purchase
3. Account & Authentication
- Accounts are created using your email address
- We use passwordless authentication (magic links) — a secure login link is sent to your email
- You are responsible for maintaining access to the email address associated with your account
- You must not share your account or magic link with others
4. Purchases & Payments
- All prices are displayed in USD and include applicable taxes and fees
- Payment is processed securely through VendaPay with 3D Secure authentication
- Your eSIM plan begins on the start date you select at checkout
- Plans expire after the stated validity period, regardless of remaining data
- You may top up an active eSIM with additional data from your dashboard
- Group orders and conference portal purchases are subject to the same terms
5. Refund Policy
- Unused eSIMs (never connected to a network) may be refunded within 30 days of purchase
- Partially used or expired plans are not eligible for refund
- Failed provisioning — if we are unable to deliver your eSIM, a full refund will be issued automatically
- Refund requests should be sent to support@wayvesim.com
6. eSIM Usage
- Each eSIM is for single-device use only and cannot be transferred between devices
- Do not delete an installed eSIM — deletion is permanent and the eSIM cannot be reinstalled
- Data roaming must be enabled on your device for the eSIM to connect at your destination
- Connection speeds depend on local carrier networks and may vary by location
- Use of the Service for illegal activities, spam, or network abuse is strictly prohibited
- We reserve the right to terminate service for excessive or abusive usage
7. Affiliate Program
Wayve offers an affiliate program for travel agents, bloggers, influencers, and conference organizers. Affiliates earn commission on referred sales subject to the following:
- Commission rates are set per affiliate and may be adjusted at our discretion
- Commission is earned only on completed, non-refunded purchases
- Affiliate commissions are capped at the markup amount on each sale
- Self-referrals (purchasing through your own affiliate link) are not eligible for commission
- We reserve the right to suspend or terminate affiliate accounts for fraudulent activity
8. Intellectual Property
- The Wayve name, logo, and brand elements are trademarks of HopSync Technologies LLC
- All content on the Service (text, images, code, design) is our property or licensed to us
- You may not copy, reproduce, or distribute our content without written permission
- Affiliates may use approved Wayve marketing materials as provided
9. Limitation of Liability
Wayve provides connectivity through third-party carrier networks. We are not responsible for:
- Network outages, speed variations, or coverage gaps beyond our control
- Carrier network maintenance or temporary service interruptions
- Device-specific issues that prevent eSIM installation or activation
- Loss of data or interruption of service during travel
Our total liability for any claim arising from the Service is limited to the purchase price of the affected eSIM plan. We are not liable for indirect, incidental, or consequential damages.
10. Disclaimers
- The Service is provided "as is" without warranties of any kind
- We do not guarantee uninterrupted, error-free, or secure service
- We do not guarantee specific speeds, coverage, or network availability at any destination
- Coverage information on our website is based on carrier-reported data and may not reflect real-time conditions
11. Termination
- You may stop using the Service at any time
- You may request account deletion by emailing privacy@wayvesim.com
- We may suspend or terminate accounts that violate these Terms
- Active eSIM plans will continue to function until expiry, even after account termination
12. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of the State of Florida.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes by posting a notice on our website or within the app. Continued use of the Service after changes constitutes acceptance of the updated Terms.
